US Work Visa for Software Engineers

Last updated

Specialized Tech Roles Fit This Visa's Rules

The H-1B visa lets US employers hire software engineers and other specialists for jobs that need a bachelor's degree or higher. The job itself must genuinely require that level of specialized knowledge, not just prefer it. You must hold the required degree, or an equivalent mix of education and experience, in a matching field. This visa ties your permission to work directly to one employer and one specific job. It does not cover general office work or jobs without a real degree requirement.

Your Employer Files Two Forms Before You Do Anything

Your employer first gets a Labor Condition Application approved, promising to pay you the proper wage for your role and location. Your employer then files a petition with the US immigration agency on your behalf, including that approved application. You cannot file for yourself; the whole process starts and ends with your employer's paperwork. Your job and your visa status are linked, so changing employers means a brand new petition. This is different from a student or tourist visa, which you control directly.

Selection Happens Before the Real Application

Each year, far more employers want H-1B visas than the law allows, so most new cases go through a random selection round. The usual yearly limit is 65,000 visas, plus 20,000 more set aside for people with a US master's degree or higher. Employers register electronically, typically in the spring, before they can file a full petition. Only employers whose registration is picked may then submit the complete case for you. Universities and some research organizations are not part of this limited pool.

What Do I Gain From H-1B Status?

H-1B status lets you live and work legally in the United States for up to three years at a time, usually renewable once. Your spouse and unmarried children under 21 can join you on a related visa. Many H-1B workers later use this time to qualify for permanent residence through their employer. Total time in this status is normally capped at six years, with some exceptions.

What Do I Need to Give My Employer's Lawyer?

Share your degree certificates and transcripts, your passport, and your current immigration documents if you are already in the country. Provide your resume and details of your past roles so your employer can show you match the job's requirements. Accurate, complete records speed up your employer's filing and reduce the chance of delays. Your employer's legal team will tell you if anything else is needed for your specific case.
